This Privacy Policy (“Policy”) applies to Way.io (also referred to as “we”, “us”, “our”). Way.io provides its advertisers and their agencies, ad exchanges, app publishers and any other ad inventory providers (its “Business Partners”) with technologies that enable the serving and display of advertising to end users (“End-User”) who access a publisher’s website, mobile app, or other online content.

This Privacy Policy (this “Policy”) is to explain how we collect, use, and transfer information received by us when individuals may interact with Way.io, its advertising technology and its website.

Privacy Policy of Way.io Advertising Service

Way.io collects data of End-User (also referred to as “you” or “your”) that interacts with ads that a website or app displays and served by Way.io. Way.io or its business partner purchases online ad inventory on a website that End-User visits or an app that End-User uses. The website or the app may initiate an ad request and share ad exchange with the End-User’s data. Ad exchange may share Way.io with the End-User’s data.

What Information Is Collected and How It Is Collected

Way.io collects and uses information about device make, device model, operating system (e.g. iOS), device type (e.g. smartphone, tablet, etc.), device properties related to screen size and orientation, network connection type, IP address, Internet browser user-agent used to access the Advertising Service, identifier for advertisers (IDFA), timestamp, iOS identifier for advertising, OS version of device, Internet (IP) addresses or geo-location data, information about when and for how long you use the Advertising Service or any service provided by Way.io's business partners, transactional data related to your interaction with an application, website, platform, or service provided by Way.io's business partners, such as information about the actions taken in an application like clicks, purchases or application installations; browser type, browser language, the date and time of your request and referral URL.

We also provide Advertising Service for our advertisers and publishers through our ad platform. We may collect the email address, account name and password, IP address and address of individuals using our ad platform.

How the Collected Information Is Used

Way.io may use data about End-User it obtains to identify the End-User that most likely to respond to a particular ad and to serve those ads. Where necessary to perform contractual obligation, Way.io may also share this information with its affiliates and Business Partners.

Way.io Advertising Service also offers data management services to Business Partners via its data management platform (“DMP”). Way.io develops custom data segments in DMP to support Business Partners’ campaign targeting within its platform. Way.io contractually requires its Business Partners to use the DMP according to any applicable law, regulation or codes of practice.

Way.io Advertising Service may also enable Way.io’s Business Partners to use data of End-User to deliver relevant advertising tailored to End-User’s interests.

Where required, Business Partner (e.g. ad exchange) will obtain End-User’s consent for and on our or our advertisers or agencies’ behalf for the processing of End-User’s personal information to display advertising on an End-User’s device. A User can withdraw their consent at any time.

Where necessary in our legitimate interests we use End-User’s personal information: (i) to understand and analyze usage trends and preferences and improve Way.io Advertising Service; or (ii) for purpose of performing the contractual obligations to our Business Partners.

We may also process data of End-User where required by any applicable laws, regulations or codes of practice, and to the extent to protect our legitimate interest and protect the rights or property of us or any other third parties.

Way.io may collect and use data about End-User for cross-app advertising, i.e., advertising across browsers and apps on a single device, as well as cross-device advertising, i.e., advertising across multiple devices. Way.io may also collect and use cross-app and cross-device information for ad delivery and performance of contact with Business Partners.

Who Do We Share End-Users’ Personal Information With

Way.io may disclose the End-User’s personal information to Business partners in order to perform Way.io’s contractual obligations, including to report the measurement of End-User’s interactions with app or website, to monitor the related traffic quality and for purpose of anti-fraud. Business partners may use the End-Users’ personal information to show End-Users relevant ads, measure End-Users’ ad/site interaction, identify End-Users’ interest areas, better understand the site and app traffic usage or End-Users’ behavior in order to improve their services. Business Partners’ process of the information that we disclose to them will be governed by their privacy policies.

We may also share aggregate or anonymous information with other third parties in accordance with the terms of this Policy.

Our affiliates may also have access to End-Users’ personal information for the purposes set out in this Policy.

We may also disclose data of End-User as required by law, or in order to comply with any governmental request or necessary to protect our rights and property, or the rights, property or safety of others, including to Business Partners, law enforcement agencies, judicial and regulatory authorities. We may also transfer End-Users’ personal information to a third party that acquires all or part of our assets or shares, or that succeeds us in carrying on all or a part of our business, whether by merger, acquisition, reorganization or otherwise.

International Transfers

If you are End-Users who are located in the European Economic Area (“EEA”), Way.io may collect your personal information through Way.io Advertising Service. Such personal information will be transferred to countries located outside the EEA (including in US), which do not provide a similar or adequate level of privacy data protection in EEA. Where required by law, our Business Partner will obtain your consent to the transfer of your personal information to countries outside EEA. You may withdraw your consent at any time.

Your Rights

You are entitled to have the following right as required by law if you are in the EEA, which may be subjected to a limited number of exceptions to the extent specified by any applicable law or regulation: (i) to request access your personal information; (ii) to correct and update any inaccurate personal information we hold; (iii) to obtain restriction of processing or to object to processing of your personal information; and (iv) ask for a copy of your personal information to be provided to them, or a third party, in a digital format.

How Do We Keep Your Information Secure

Way.io uses reasonable technical and organizational measures to protect the data about End-User, including but not limited to use firewalls, encryption technology and other automated software designed to protect against authorized access. We also seek appropriate contractual protection from Business Partners regarding their processing of data of End-User. We also strictly control and monitor physical access to data of End-User by reasonable electronic means.

Way.io may retain data about End-User for a period to the extent necessary for performing the purpose stated in this Policy, unless otherwise required by law or applicable contract. Way.io will determine the period to retain End-User’s data based on reasonable factors to the extent permitted by law or regulation, such as the time needed to retain the personal data as necessary to provide Way.io Advertising Service, the type of personal data collected, any legal, contractual or similar obligation to retain the data we may subject to.

COPPA

Way.io is not intended to target children under the age of 13. We ensure that we complies with the Children's Online Privacy Protection Act (COPPA).

Way.io operates a corporate website at www.way.io which provides visitors (also referred to as “you” or “your”) of information about our product and service and which is intended to be used by Business Partners. This Policy describes the information we collect, use, and share through Way.io corporate website.

What Information Is Collected and How It Is Collected

When you visit Way.io’s corporate website, we may collect certain types of technical and usage information automatically, including through the use of Cookies and other similar tracking technologies. These information may include IP address, domain name, visit time, browser type, Internet Protocol Address, cookies, Internet Tags and navigational data, and any other technical information. Visitors which may be prospectus business partner visiting Way.io’s corporate website may also contact Way.io by actively submitting their information, including name, physical addresses, telephone number, e-mail address and job title.

Business Partners can access to Way.io Advertising Service through Way.io’s corporate website. Way.io may collect information of Business Partners including, for example, e-mail addresses, telephone numbers and billing details in the ordinary course of business.

How the Collected Information Is Used

Way.io uses personal information of visitors of Way.io’s corporate website or Business Partners using Way.io Advertising Service through the corporate website in order:

  1. To provide information about Way.io’s product or service;
  2. To perform contracts with Business Partners, such as to maintain Business Partner accounts, billing, account management and to better serve Business Partner’s needs;
  3. To share with third parties to provide necessary technical support service to Way.io;
  4. For business administration, including internal statistical analysis;
  5. To contact and respond to visitors’ requests and enquiries.

Who Do We Share End-Users’ Personal Information With

We may share information collected through the Way.io corporate website (i) with third parties to operate or improve the Way.io corporate website, or to improve Way.io Advertising Service; (ii) with Way.io’s affiliated companies for purpose provided in this Policy; (iii) to comply with obligations required by law as required or permitted by law; (iv) to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property, or the rights, property or safety of others, including to advisers, law enforcement agencies, judicial and regulatory authorities; (v) to transfer to a third party that acquires all or part of our assets or shares, or that succeeds us in carrying on all or a part of our business, whether by merger, acquisition, reorganization or otherwise.
